A Federal High Court in Lagos has affirmed the authority of the Federal Competition and Consumer Protection Commission (FCCPC) to investigate complaints relating to airline ticket pricing and other consumer protection issues in Nigeria’s aviation sector. The judgment followed a legal challenge over whether the FCCPC had the power to probe airlines despite the regulatory role of the Nigerian Civil Aviation Authority (NCAA). Delivering its ruling, the court held that the FCCPC is legally empowered under the Federal Competition and Consumer Protection Act to investigate consumer complaints, including those concerning airline ticket pricing, provided its actions do not conflict with sector-specific regulations. The court clarified that while the NCAA remains the primary regulator of the aviation industry, the FCCPC retains concurrent powers to protect consumers and enforce competition laws where applicable. The decision reinforces the commission’s role in addressing complaints from passengers over airfare pricing and other consumer rights issues. The case stemmed from objections raised over the FCCPC’s investigation into airline ticket pricing practices. The ruling is expected to strengthen consumer protection oversight in Nigeria’s aviation sector while affirming that both regulators have distinct but complementary responsibilities.
