Rivers Crisis: Court rejects State House of Assembly’s attempt to restrict Fubara’s public spending

The Federal High Court in Abuja has ruled that Governor Siminalayi Fubara is not prohibited from using public funds in the interim till the hearing and resolution of the lawsuit brought by the Rivers State House of Assembly.

Despite ordering the plaintiffs to serve notice on the defendants, Justice Emeka Nwite denied the prayers in his ruling on the motion ex parte with the file number FHC/ABJ/CS/984/24.

Judge Nwite, however, granted the motion ex parte to serve the fifth through tenth defendants in the case using substituted methods.

He stated: “The plaintiffs/applicants are hereby granted leave to serve the fifth through tenth defendants/respondents with the plaintiffs/applicants’ originating and any other process (es) filed or issued in this suit by substituted means, such as by publishing them in the Nation Newspapers.”

The judge further adjourned the hearing to August 7th to consider the application on notice.

The 1st and 2nd plaintiffs the Rivers State House of Assembly and Martin Amaewhule, had filed the suit through their counsel, Joseph Daudu against the Central Bank of Nigeria, Zenith Bank Plc, Access Bank PLC, and the Accountant General of the Federation as the 1st to 4th defendants.

BREAKING: Court grants El-Rufai N100m bail with strict conditions

Nasir El-Rufai has been granted bail in the sum of N100 million by the Federal High Court in Abuja, as legal proceedings against the former governor continue. According to The Nation, Justice Joyce Abdulmalik ruled on Monday that El-Rufai must provide one surety in like sum to secure his release. The court imposed stringent conditions. The surety must be resident in Maitama or Asokoro in Abuja and must submit the original Certificate of Occupancy for a landed property to the court registry. The surety is also required to be a federal civil servant not below Grade Level 17. Additional requirements include an affidavit of means, execution of a bail bond and submission of a recent passport photograph. The court also directed El-Rufai to surrender all valid international passports and to report monthly to the Department of State Services headquarters every last Friday at 10am to sign an attendance register pending the conclusion of the trial. In a further condition, the former governor must submit a letter of attestation from the Kaduna Traditional Council. Justice Abdulmalik warned that any breach of the bail terms would lead to automatic revocation. The Nation reported that the matter has drawn heightened attention following earlier proceedings involving allegations linked to the interception of conversations involving Nuhu Ribadu.
