A Federal High Court in Abuja has adjourned a suit filed by former Vice-President and African Democratic Congress (ADC) presidential candidate, Atiku Abubakar, challenging President Bola Tinubu’s eligibility to contest the 2027 presidential election.
The case, filed on Friday, was stalled after Atiku’s counsel, Joseph Onu, told the court that he had been unable to personally serve the originating summons on Tinubu.
Onu requested permission to serve the president either directly or through substituted service.
Counsel to President Tinubu attempted to receive the originating summons, but Onu declined, insisting that the defendant must be served personally or through substituted service.
Atiku’s suit centres on an alleged discrepancy in the name on the National Youth Service Corps (NYSC) discharge certificate submitted by Tinubu to the Independent National Electoral Commission (INEC).
The plaintiffs allege that the certificate bears the name “Tinubu Bola Adekunle”, while the president is officially known as “Bola Ahmed Tinubu”.
They want the court to determine whether the alleged difference in names affects Tinubu’s constitutional eligibility to contest the 2027 presidential election.
Justice Inyang Ekwo adjourned the matter until September 28, 2026, for further mention.
Tinubu defeated Atiku in the 2023 presidential election. Both politicians are again positioning themselves for the 2027 presidential contest, with Tinubu expected to fly the flag of the All Progressives Congress (APC), while Atiku is representing the ADC.
